Information pursuant to Art. 13 of Regulation (EU) 2016/679 (“GDPR”)

Data controller

Marina Development Corporation, having its registered office at Passeggiata Marconi 24, 18039, Ventimiglia, Italy, in its capacity as data controller of your personal data (hereinafter, the “Data Controller“), which can be contacted at info@mdc.tl, pursuant to the GDPR and the applicable data protection legislation, provides you with the following information on the processing of your personal data in connection with your expression of interest in the residential units (Marina di Ventimiglia or Marina di Pisa) which will be soon commercialised by the Data Controller.

Categories of personal data and purpose of the processing

The processed personal data include, but are not limited to, personal and identification data (e.g. first name, last name, name of the company to which they are related), contact data (e.g. address, mobile phone number and/or email address) and information regarding the residential units which You are interested in (the “Personal Data“).

The Personal Data will be processed for the purposes of contacting you and providing you with information on the residential units that correspond to the types in which you have expressed an interest, either when such properties are ready to be commercialised, or, if necessary, prior to that stage.

The legal basis justifying the processing of Personal Data is the need to execute pre-contractual measures which will be adopted at your request, having regard to the explicit expression of interest that you have provided to the Data Controller by means of the interest registration form. Not all the requested Personal Data are compulsory, as long as you provide the Data Controller with the essential Personal Data needed to contact you. Failure to provide the Personal Data will not result in any prejudice, except for the fact that the Data Controller will not be able to contact you in order to reply to your expression of interest.

Processing methods and storage period

Processing of the Personal Data provided may be carried out either physically (on paper supports and paper archives) and/or by means of electronic or automated devices (on computer and audio/video archives). The processing methods guarantee the confidentiality and security of the information.

In any event, Personal Data shall be processed in accordance with the principles of fairness, lawfulness and transparency provided under the GDPR. Personal Data shall be stored in the Data Controller’s archives for a maximum period of 12 months following the date of commencement of the commercialisation of the residential units and, in any case, for no longer than 36 months from the date on which your Personal Data have been collected, unless the law provides for a different storage period, also in order to allow the Data Controller to defend its own rights. Once the aforementioned storage terms have expired, the Personal Data stored in the Data Controller’s archives will be deleted.

Recipients of the processing

The Personal Data provided and elaborated will be processed by personnel of the Data Controller who are specifically authorised to do so, in connection with the performance of activities that are strictly related and pertaining to your expression of interest, as well as, where necessary, by employees and/or professionals, including those from external companies, appointed and authorised to carry out activities and/or services on behalf of the Data Controller, duly appointed as data processors pursuant to Article 28 GDPR.

The Personal Data will not be transferred outside the European Union.

Rights of the persons concerned

The GDPR and the applicable data protection legislation gives you specific rights over your Personal Data, as described below: the right to know which of your Personal Data are being processed by the Data Controller and to be provided with a gratuitous copy of the same (in case of further copies requested, you may be charged with a fee based on the costs incurred the right to obtain the updating or amendment of any inaccurate or incomplete Personal Data that concern your person; the right to obtain the deletion of your Personal Data in the specific cases provided for under the GDPR and data protection legislation; the right to request the restriction of the data processing; the right to portability, in the cases provided for under the GDPR and data protection legislation; the right to object to the data processing at any time, for reasons relating to the specific situation.

In order to exercise the rights referred to in this paragraph, you may contact the Data Controller directly and at any time at the e-mail address info@mdc.tl or at the address indicated above. You can always lodge a complaint with the Garante per la protezione dei dati personali against decisions of the Data Controller which are deemed to be in breach of the GDPR, according to the procedures available at www.garanteprivacy.it.
